Delivery

  1. Shipping Costs and Risk
    Delivery is not carriage paid, which means that shipping costs are at the buyer’s expense, unless otherwise agreed in writing. As soon as the products are made available by hmbx.nl to the buyer or to a person designated by him, they are at the expense and risk of the buyer. This applies from the moment of loading, transport and unloading by the buyer or his designated person.
  2. Verzekering
    hmbx.nl is at all times authorized to insure the products for the account and at the expense of the customer against risks to be determined by hmbx.nl and/or to take measures in this regard.
  3. Force majeure
    If the products cannot be transported to the agreed destination due to force majeure, as described in article 12, hmbx.nl is entitled to store these products at the customer’s expense and risk and to demand payment without the customer having any right to suspension and/or settlement.
  4. Purchase obligation
    The customer is obliged to accept the products at the moment they are made available to him by hmbx.nl. If the customer refuses to accept the products, hmbx.nl is entitled to store and/or insure the products at the customer’s expense and risk.
  5. Partial deliveries
    hmbx.nl is authorized to make partial deliveries and invoice accordingly.
  6. Delivery on Call
    If delivery on call has been agreed, the customer is obliged to take delivery of the products according to the agreed call and delivery schedule.
  7. Delivery time
    Delivery and shipment take place within 3 working days, unless otherwise agreed.

Returns

  1. Inspection upon Delivery
    The buyer is obliged to check the products for conformity with the agreement immediately after delivery, regardless of the place and time of delivery.

  3. Oral and Late Claims
    Oral complaints and complaints submitted after seven days will not be considered. If products are collected directly from hmbx.nl, complaints can only be made immediately upon delivery.
  4. Returning
    hmbx.nl is never obliged to return delivered products. If hmbx.nl agrees to the return in writing, the products must be returned undamaged and in their original packaging. The costs for returning the products are for the customer.
  5. Repairs
    If products are returned for repair, any repair and transport costs will be charged to the customer.
  6. Suspension of Payment
    Submission of claims shall never suspend payment of the relevant invoice.
